These Terms & Conditions ("Terms") apply to your use of the DYVAL website and to products, digital content and services supplied by DYVAL Pty Ltd ("DYVAL", "we", "us" or "our").
By accessing or using our website, purchasing a product, purchasing or accessing digital content, creating an account or otherwise using our services, you agree to these Terms.
If you do not agree with these Terms, please do not use our website or purchase or access our products, digital content or services.
1. ABOUT DYVAL
DYVAL provides products, information and educational content designed primarily around sport, nutrition, hydration and the development of young athletes.
Our offerings may include, but are not limited to:
- hydration and electrolyte products;
- protein products and other food or nutrition products;
- drink bottles, apparel, accessories and other physical products;
- recipe eBooks and nutrition guides;
- downloadable digital products;
- educational resources;
- football skills and training videos;
- sports coaching and instructional content;
- video programs, courses and other digital content;
- product subscriptions or recurring orders; and
- other products, services and content introduced by DYVAL from time to time.
The products and services available may change without notice.
2. USE OF OUR WEBSITE
You may use the DYVAL website for lawful, personal and non-commercial purposes.
You must not:
- misuse the website;
- interfere with its operation or security;
- attempt to gain unauthorised access to any part of the website;
- copy or reproduce our content except as permitted by these Terms;
- use our website or content for unlawful purposes; or
- use our intellectual property for commercial purposes without our written permission.
We may modify, suspend or discontinue any part of the website at any time.
3. ACCOUNTS

4. ORDERS AND PAYMENTS
When you place an order through the DYVAL website, you are making an offer to purchase the relevant product or service.
An order is not necessarily accepted by us until payment has been successfully processed and we have confirmed the order.
All prices are displayed in Australian dollars unless otherwise stated.
Where applicable, prices include GST.
You are responsible for providing accurate billing, delivery and contact information.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- an incorrect price has been displayed;
- we suspect fraudulent activity;
- there has been an obvious website or pricing error; or
- the order cannot reasonably be fulfilled.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.
5. PRODUCT INFORMATION AND AVAILABILITY
We make reasonable efforts to ensure product descriptions, photographs, nutritional information, pricing and other information displayed on our website are accurate.
However, minor differences may occur between website images and the actual product, including differences in packaging, colour and appearance.

6. SHIPPING AND DELIVERY
Shipping costs and available delivery options will be displayed at checkout or elsewhere on the website.
Any delivery timeframes provided by DYVAL are estimates only.
Delivery may be affected by circumstances outside our reasonable control, including courier delays, weather, public holidays and other disruptions.
You are responsible for ensuring the delivery address supplied with your order is correct.
If an order is returned to us because an incorrect or incomplete delivery address was supplied, additional delivery charges may apply before the order is resent.
7. RETURNS, REFUNDS AND AUSTRALIAN CONSUMER LAW
Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.
Change of mind
Unless otherwise stated on our website, DYVAL does not provide refunds or exchanges simply because you change your mind, order the wrong product or no longer want the product.
This does not affect your rights under the Australian Consumer Law.
Faulty, damaged or incorrect products
If you believe a product is faulty, damaged, incorrectly supplied or otherwise fails to comply with a consumer guarantee, please contact us as soon as reasonably possible with your order details and, where appropriate, photographs of the issue.
We will assess the matter and provide the remedy required under applicable Australian consumer law.
8. FOOD, HYDRATION AND NUTRITION PRODUCTS
DYVAL products may include foods, beverages, hydration products, electrolyte products, protein products and other nutrition products.
You are responsible for reading the product label, ingredient list, allergen information, directions for use and any warnings before consuming or providing a DYVAL product to another person.
Individual nutritional requirements vary according to factors including age, body size, diet, activity level, training load and health circumstances.
DYVAL products should be used in accordance with the directions provided on the product packaging.
Our products are not intended to diagnose, treat, cure or prevent disease.
If you or your child has a medical condition, allergy, food intolerance, special dietary requirement or other health concern, you should seek appropriate professional medical or dietetic advice before using a product where necessary.
9. INFORMATION FOR PARENTS AND YOUNG ATHLETES
DYVAL is a brand that creates products and educational content relevant to young athletes.
Where a product, activity, training program or piece of content is intended for or used by a child or young person, a parent or guardian is responsible for determining whether it is appropriate for that individual.
Parents and guardians should consider the young person's:
- age;
- health;
- allergies and dietary requirements;
- physical development;
- fitness and sporting experience;
- injuries or medical conditions; and
- individual nutritional and training needs.
Where appropriate, professional medical, dietetic, physiotherapy, coaching or other relevant advice should be obtained.
10. DIGITAL PRODUCTS
DYVAL may sell or provide digital products including:
- recipe eBooks;
- nutrition guides;
- training guides;
- downloadable resources;
- educational materials;
- football skills videos;
- coaching videos;
- courses;
- video programs; and
- other digital content.
Unless otherwise stated, purchasing digital content gives you a limited, personal, non-exclusive and non-transferable licence to access and use that content for your own personal or household use.
Purchasing digital content does not transfer ownership of the content or intellectual property to you.
You must not, without our prior written permission:
- reproduce or copy digital content;
- distribute it to others;
- upload it to file-sharing services;
- share login or access details;
- resell it;
- publish it online;
- screen-record or reproduce paid video content;
- use it to create competing products or services; or
- otherwise commercially exploit DYVAL content.
11. DIGITAL PRODUCT REFUNDS
Because digital products may be delivered or made accessible immediately after purchase, we do not generally provide refunds for change of mind once a digital product has been downloaded, accessed or supplied.
This does not exclude any rights or remedies you may have under the Australian Consumer Law.
If a digital product is faulty, materially different from its description or cannot reasonably be accessed due to an issue attributable to DYVAL, please contact us so we can investigate and provide an appropriate remedy where required by law.
12. FOOTBALL SKILLS, TRAINING AND COACHING CONTENT
DYVAL may provide football skills demonstrations, drills, exercises, training programs, coaching videos and other sporting content.
This content is provided for general educational and instructional purposes only.
Sport and physical activity involve inherent risks, including the risk of injury.
Not every drill, exercise or training method is suitable for every person.
Before participating, users and parents or guardians should consider the participant's age, ability, physical development, fitness, existing injuries, health conditions and playing environment.
Participants should:
- use appropriate equipment;
- train in a safe environment;
- follow appropriate warm-up and safety practices;
- stop an activity if they experience pain, dizziness or unusual symptoms; and
- seek professional medical or allied health advice where appropriate.
DYVAL does not guarantee that completing any training, skills program or coaching content will result in team selection, improved sporting performance, scholarships, professional contracts or any particular sporting outcome.
Where a young athlete uses DYVAL training content, appropriate adult supervision should be provided having regard to the athlete's age and the activity involved.
13. GENERAL HEALTH AND NUTRITION INFORMATION
Information provided by DYVAL through our website, articles, recipes, eBooks, social media, videos and other content is provided for general educational and informational purposes.
It is not intended to replace personalised medical, nutritional, dietetic, physiotherapy or other professional healthcare advice.
Information about nutrition, hydration, training, recovery and sport may not be appropriate for every individual.
If you have concerns about your own health or your child's health, nutrition, growth, development, injury or medical condition, you should consult an appropriately qualified healthcare professional.
14. RECIPES AND NUTRITIONAL INFORMATION
Any calories, macronutrients or other nutritional information provided with DYVAL recipes or content are estimates unless expressly stated otherwise.
Actual nutritional values may vary depending on the specific brands, ingredients, serving sizes, preparation methods and substitutions used.
You are responsible for checking ingredients and allergen information to determine whether a recipe is appropriate for you or your family.
15. SUBSCRIPTIONS AND RECURRING PRODUCT ORDERS
DYVAL may offer certain physical products on a subscription, autoship or recurring-order basis.
Where you purchase a subscription product:
- the frequency and price of the subscription will be displayed before purchase;
- you authorise us or our payment provider to charge the applicable payment method for each recurring order;
- your subscription will continue until cancelled in accordance with the cancellation process;
- prices may change in accordance with applicable law and any notice requirements; and
- you are responsible for maintaining valid payment and delivery details.
You may cancel a product subscription through the account or subscription management facility provided on our website or by contacting DYVAL customer service.
To avoid an upcoming recurring order being processed, cancellation should be completed at least 2 business days before the scheduled processing or renewal date.
If an order has already been processed or dispatched before a cancellation takes effect, that order may still be supplied and charged.
Where available, you may also be able to skip or reschedule a recurring order through your subscription management area.
Cancelling a subscription prevents future recurring orders; it does not automatically cancel or refund an order that has already been processed.
Nothing in this section limits your rights under the Australian Consumer Law.
16. PROMOTIONS, DISCOUNTS AND COMPETITIONS
From time to time DYVAL may offer promotional codes, discounts, giveaways or competitions.
Additional terms may apply to a particular promotion or competition.
Unless otherwise stated:
- discount codes cannot be exchanged for cash;
- discount codes cannot be retrospectively applied to completed orders;
- promotions may have specified start and end dates;
- certain products may be excluded; and
- multiple discount codes may not be able to be used together.
Competition-specific terms will apply where required.
17. INTELLECTUAL PROPERTY
All intellectual property associated with DYVAL, including our:
- brand name;
- logos;
- trademarks;
- website;
- product designs;
- packaging;
- photographs;
- videos;
- recipes;
- eBooks;
- training materials;
- football drills;
- educational resources;
- written content;
- graphics; and
- other original materials
is owned by or licensed to DYVAL unless otherwise stated.
You may not reproduce, distribute, modify, sell, commercially exploit or create derivative works from DYVAL intellectual property without our prior written permission, except where permitted by law.
18. USER-GENERATED CONTENT
If you submit, tag or provide DYVAL with photographs, videos, reviews, testimonials or other content, you warrant that you have the right to provide that content.
Where we wish to use identifiable photographs or videos of children or young athletes for DYVAL marketing, we may seek appropriate permission from a parent or guardian where required.
Nothing in this section permits DYVAL to use personal information contrary to our Privacy Policy or applicable privacy laws.
19. THIRD-PARTY LINKS AND SERVICES
Our website may contain links to third-party websites, social media platforms, payment providers, delivery providers or other services.
DYVAL does not control those third parties and is not responsible for their content, availability, privacy practices or services.
Accessing a third-party website or service is at your own discretion and may be subject to that provider's own terms and privacy policy.
20. PRIVACY
Personal information collected through the DYVAL website will be handled in accordance with our Privacy Policy and applicable Australian privacy laws.

Where you have purchased digital content and experience an access issue, please contact us so we can reasonably attempt to resolve the issue.
22. LIMITATION OF LIABILITY
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
To the maximum extent permitted by law, DYVAL is not liable for indirect or consequential loss arising from your use of the website, products, services or content.
Where our liability can lawfully be limited, our liability will be limited to the remedies permitted by applicable law.
Nothing in these Terms is intended to exclude liability where doing so would be unlawful.
23. INDEMNITY
To the extent permitted by law, you agree to indemnify DYVAL against loss, damage, liability, claims or reasonable costs arising directly from:
- your material breach of these Terms;
- your unlawful use of the website or DYVAL content;
- your infringement of another person's intellectual property rights; or
- content you provide to DYVAL where you do not have the necessary rights or permissions.
This clause does not apply to the extent that the relevant loss was caused or contributed to by DYVAL or where such an indemnity would be prohibited by law.
24. CHANGES TO PRODUCTS, CONTENT AND SERVICES
DYVAL is a developing brand and our products and services may evolve.
We may introduce, modify or discontinue products, flavours, digital content, videos, programs, services and other offerings from time to time.
We may also update these Terms to reflect changes to our business, technology, products or applicable laws.
The most current version of these Terms will be published on our website.
25. GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia.
You and DYVAL submit to the jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.
Nothing in this clause limits any rights you may have under applicable consumer protection legislation.
26. SEVERABILITY
If any part of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed to the extent necessary without affecting the remaining provisions.
